01. All equipment remains the property of Colette Crofts (Owner) of Couture Chair Covers, 8 Mill Lane, Heswall, Wirral, Merseyside, CH60 2TG.

02. DURING THE PERIOD OF HIRE, THE HIRER IS SOLELY RESPONSIBLE FOR THE HIRED GOODS and the Hirer shall at all times be responsible for insuring all goods, from the time of acceptance of the goods until the time they are returned and accepted back into the possession of the Owner.

03. The Owner shall not be responsible for any injury or damage to persons or property arising from the use of any equipment under hire. Couture Chair Covers shall in no circumstances be liable for any direct, indirect or consequential loss, damage or extra costs incurred caused by its negligence or other default in the performance of its duties.

04a. Damage Deposit: In the case of non-account holding customers (any exceptions agreed prior), a sum of money (damage deposit) is payable as an addition to the hire charges paid, at a rate of £50 per 100 covers and a minimum of £50. This is fully refundable as long as the hire goods are undamaged and is best paid as a cheque that we return or destroy once the hire goods have been collected & checked for damage (see FAQ's for description of damaged goods).

NB We aim to be "reasonable" in all areas of our business transactions, we do not wish to profit from any part of our supply that is covered by the Damage Deposit…it is there purely as a safeguard.

04b. Booking Deposit: This secures the selected goods as agreed, on the date agreed at time of booking and is payable in two ways. There are 2 options as below:-
Option 1 A 50% deposit with payment of outstanding balance 2 weeks prior to the event (if you cancel up to 6 weeks before the event then 75% of the deposit is refunded to you or we can transfer the full deposit to another date within 1 year).

Option 2 A 15% deposit (non refundable); the outstanding balance (refundable) to be paid by an equal amount monthly standing order over the remaining time period.

05. Shortage and damage to goods (and packaging in the DIY option) will be charged according to the full replacement value at the time of hire (details of which are available on request) and deducted from the Damage Deposit . Should the Hirer wish to have any damaged goods returned for inspection or appraisal, the Owner must be advised of these damaged goods by telephone or email within 2 working days of the goods being collected. If not advised we shall assume the Hirer accepts responsibility for the damage and deduct the replacement cost from their Damage Deposit (or invoice account customers). If the Hirer informs us of disputed damaged returned goods these goods will then enter a quarantine situation (for evaluation) and a hirers dispute raised. We will then confirm the damage and email the hirer to negotiate/advise on the action to be taken.

06. When the goods on hire are delivered to the Hirer, they shall inspect the goods and sign the owners delivery note. In the event of shortage or damage the hirer shall endorse the note accordingly at the time of delivery. If the Hirer fails to perform any of his obligations under this condition, any goods will be deemed to have been delivered in a clean undamaged condition. Collection of goods from Hirer; the Owner is deemed to be collecting the same number of Hire goods as was delivered and it is assumed that all returned goods are in a good condition and re-hireable after laundering, hence, any damaged or missing goods will charged for.

07. The Owner must be informed immediately of any extension in the hire period, and the hirer may be charged extra accordingly (excepting force majeur and documented reasons). Standard hire is per 72 hours (including set up and removal if that service was agreed to) and the goods will be collected at the address agreed to.

08. Goods must be available for collection at the delivery address, unless otherwise agreed. All deliveries and collections for DIY service will be charged for. Any missed collections will be charged for. Any extra days hire from the agreed collection date will be charged for at a rate of 30% of the hire value per day.

09. No goods (substitutes) will be accepted by the owner other than those that have been hired from the Owner and specified on the delivery/collection note. Any goods returned which do not belong to the owner will be notified to the hirer as such and a charge for replacements at appropriate stated rates applied. Should these goods not be collected within 28 days the Owner reserves the right to dispose of them or apply a storage charge. Should the hirer wish to have them returned to them then it is at the hirers' expense.

10. . Any person who is not the hirer but who signs a delivery / collection note is deemed to be authorised to do so.

11. Prices are not subject to VAT.

12. The hire shall be deemed to continue until the goods are made available to the owner or returned to their possession. In the case of a late return of hired goods on the part of the hirer a hire charge equivalent to the daily hire rate will be made (one third of the Hire amount). It is the hirers responsibility to ensure the goods are collected when the DIY service is selected and we recommend collection from either a home or work address to eliminate extra hire and courier charges.

13. For approved customers, our terms are strictly nett 30 days, cheques must be cleared in our Bank on day 31. We reserve the right to charge interest as per the late payment of Commercial Debts (interest) Act as amended and supplemented by the Late Payment of Commercial Debts Regulations 2002, should payment be delayed.

14. We will make every effort to deliver and collect at the times requested by the hirer, however, although removal will be as promptly as possible, we cannot guarantee collection immediately after use from every venue at the same time. It is the Hirers responsibility to ensure that the goods are kept dry and in a secure place until collected.

15. We will endeavour to supply the specific items requested, however we reserve the right to substitute an appropriate alternative if necessary. All colours shown on our website, sales literature and swatch cards are only representative of the actual colour as shades may vary, and we would always recommend viewing samples prior to booking)

16. Goods will only be counted on site at the specific request of the hirer to our office in advance. A named representative must be present to check the goods with our driver and countersign the collection note. Failing this all items will be counted and checked upon return to our premises and our decision as to losses / damages will be final. In the case of items being collected by a third party courier they are not authorised to check the goods and our decision is final.

17. All DIY Goods must be returned in the original plastic boxes that they were delivered in.
